Welcome to Equithing! These Terms of Use ("Terms") govern your access to and use of the Equithing mobile application ("App") provided by Mos Pelgo Ventures BV("Equithing," "we," or "us"). Please read these Terms carefully before using the App. By accessing or using the App, you agree to be bound by these Terms. If you do not agree with these Terms, you may not use the App.
By using the Equithing mobile App, you agree to these Terms and represent that you are at least 18 years old or have obtained parental or guardian consent to use the App. If you are using the App on behalf of an organization, you represent and warrant that you have the authority to bind that organization to these Terms.
Equithing is a mobile application specifically designed for horse enthusiasts. The App provides users with features including horse management, health logging, event management, and the ability to add and share media such as videos and photos related to horses.
To access certain features of the App, you may be required to create an account. You agree to provide accurate, current, and complete information during the registration process and to update such information as necessary to keep it accurate, current, and complete. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.
You are solely responsible for maintaining the security of your account and the App. You must not share your account credentials with others or allow unauthorized access to your account. If you become aware of any unauthorized access or use of your account, you must notify Equithing immediately.
When using the App, you agree to abide by applicable laws and regulations.
You must not:
a) Use the App for any illegal, fraudulent, or unauthorized purposes.
b) Interfere with or disrupt the operation of the App or its servers.
c) Use any automated means or interface not provided by Equithing to access or use the App.
d) Engage in any activity that may damage, disable, overburden, or impair the App or its functionality.
You are solely responsible for the content you submit, post, or display through the App. You must not upload, publish, or transmit any content that:
a) Violates any third-party rights, including intellectual property rights.
b) Contains offensive, defamatory, or discriminatory material.
c) Promotes or facilitates illegal activities.
d) Contains viruses, malware, or any other harmful code.
e) Violates any applicable laws or regulations.
The Equithing App and its content, including but not limited to text, graphics, images, logos, and software, are the property of Equithing or its licensors and are protected by intellectual property laws. You may not use, reproduce, modify, distribute, or display any portion of the App without the prior written consent of Equithing.
Equithing respects your privacy and is committed to protecting your personal information. Our collection, use, and disclosure of personal data through the App are governed by our Privacy Policy, which is incorporated by reference into these Terms. By using the App, you consent to the collection, use, and disclosure of your personal information as described in the Privacy Policy.
You retain ownership of any content, videos, photos, or other media that you upload or share through the App. By uploading or sharing such content, you grant Equithing a non-exclusive, worldwide, royalty-free license to use, reproduce, modify, distribute, and display the content solely for the purpose of operating, promoting, and improving the App.
You are solely responsible for the content you upload or share through the App. Equithing does not claim any ownership rights in your content. However, by uploading or sharing content, you represent and warrant that you have the necessary rights to grant the license mentioned in Section 7.1, and that the content does not infringe any third-party rights or violate any applicable laws.
THE APP IS PROVIDED "AS IS" AND WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED. EQUITHING DISCLAIMS ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. EQUITHING DOES NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE, NOR DOES IT MAKE ANY REPRESENTATIONS REGARDING THE ACCURACY, RELIABILITY, OR CURRENCY OF ANY INFORMATION PROVIDED THROUGH THE APP.
IN NO EVENT SHALL EQUITHING BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE APP, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, OR GOODWILL. IN NO EVENT SHALL EQUITHING'S AGGREGATE LIABILITY EXCEED THE AMOUNTS PAID BY YOU, IF ANY, FOR ACCESSING OR USING THE APP DURING THE TWELVE (12) MONTHS PRECEDING THE CLAIM.
These Terms shall be governed by and construed in accordance with the laws of Belgium.
These Terms constitute the entire agreement between you and Equithing regarding the App and supersede all prior or contemporaneous agreements, understandings, or representations.
